Tasers are used any time an officer feels they or the public are going to be seriously hurt by someone, said Knapman. If an officer is in that kind of danger, they could also draw their gun. In fact, if an officer is alone in that kind of situation, they would draw their gun and not their Taser.

In investigating the suicide in Cape Breton, for instance, SIRT concluded that one of the Taser's darts entered the man's back, while the other landed in the hem of his shorts and did not penetrate his skin.

In September 2017, a Cape Breton, N.S., man also died after a stun gun didn't work. The man was trying to harm himself by jumping from an overpass, and a Cape Breton Regional Police officer fired his Taser to try to immobilize him. It struck the man but but didn't stop him, and an instant later, he died by suicide, according to a report by Nova Scotia's police watchdog, the Serious Incident Response Team (SIRT).

We firmly believe almost every litigation matter could benefit from an ESI protocol that governs the logistics and specifics of document productions. Oriola said when stun guns don't work, the person who was hit with one can become even more agitated and lash out. He said police forces across the country use stun guns far too frequently and should focus on de-escalation, ways of calming people down to reduce the chances of conflict.

The honest truth is we’re all human, and mistakes will be made no matter how careful we are. It’s therefore prudent to make sure we have failsafes in place such as baking in a clawback agreement to your ESI Protocol and/or an FRE 502(d) agreement.

But the success rate isn't high enough for Temitope Oriola, a criminology professor who studied stun guns at the University of Alberta in Edmonton. He said he doesn't know of anyone tracking how often stun gun failures lead to police using deadly force.

In the world of paper productions, redactions were a manual process. When a document needed to have information redacted, we would make a copy and then use a permanent marker to make a thick black mark over the privileged text. Manual redaction procedures look different in the digital world, but still seem to confuse legal professionals. The most notable act of carelessness involves opening a PDF and simply drawing a black box/rectangle over text to be hidden and calling it complete. But what a vast majority of lawyers fail to understand is that PDF files have both an image layer AND a text layer. Drawing a black box hides the content on the image layer but the text layer stays intact – that means anyone can still search the text or simply highlight the “redacted” area to copy and paste the text into another document.

In September 2018, there was another incident in Lower Sackville where the RCMP responded to a report of a woman becoming violent after taking drugs. Officers fired a stun gun at her, and the darts struck her midsection and leg. She was momentarily stunned, then removed one of the darts, ending the effects of the weapon.

They tried to use a Taser on Levi multiple times. But it didn't immobilize him, and he was shot and killed by an officer. It's not clear why the Taser didn't work. A coroner's inquest has been ordered into Levi's death.

The most important rule for proper redactions is simply to use the right tool for the job. Anything less and you set yourself up for the inevitable oversight, embarrassment, or sanction.

On June 12, officers responded to a complaint of an unwanted person at a home near Miramichi, N.B., according to an RCMP spokesperson. When they arrived, RCMP said, they faced Levi, who was holding knives.

A pertinent clause to include in your ESI protocol is to specify how redactions should be applied, including the reasoning (e.g. confidentiality, privilege, non-relevant, etc.), so that there are adequate grounds for clawing back inadvertently or mis-redacted information.

In some cases, it's not obvious why a stun gun doesn't incapacitate a person. In other cases, it's more clear: For instance, a stun gun doesn't work unless two or more of the darts it fires connect with a person.

Lombard wants police forces across the country to cut down on how often they use all their weapons. She said communication is key.

"I mean, how do you jump from one being sufficient to the other being justifiable in a matter of seconds? It doesn't make a lot of sense to me."

When one of the darts, also called probes, doesn't strike the person, the electric circuit can't be formed and the person isn't immobilized, said Knapman. Loose-fitting clothing can keep the probes from reaching a person, preventing the weapon from working.

Axon, the company that manufactures Tasers, said its weapons require two or more probes to connect with a target and they must hit sufficient muscle mass to effectively incapacitate someone.

To be fair, there are several reasons why information might need to be redacted. Most of the time it’s to protect personal identifiable information (PII), sensitive business information, or some other confidential/privileged coverage. In rare instances, parties might agree to redact information they deem non-relevant to the matter so they can focus on the most pertinent details.

In fact, a major blunder recently occurred when Sony was required to produce documents in the Federal Trade Commission v. Microsoft, 3:23-cv-02880, (N.D. Cal.) matter. They allegedly used a black Sharpie marker in an attempt to redact proprietary financial information, inadvertently disclosing profit margins the company certainly did not want to be made public. Did the printed text bleed through the Sharpie marks? Did the (presumably technologically competent) legal team use some other inadequate tools for redaction and fail to check their work?

Despite the limitations, Knapman said, Tasers and other stun guns are an excellent tool and make police work much safer for officers and the public. He said in some cases a Taser can safely resolve what might otherwise be a lethal encounter.

In October 2017, a man in Lower Sackville was trying to harm himself so officers used a stun gun on him, but it "appeared to have minimal effect as the AP (Affected Party) continued to be combative," said a SIRT report.

Tasers and other stun guns can fail for a number of reasons, according to RCMP Sgt. Wayne Knapman, the non-commissioned officer in charge of the training section for the RCMP in Nova Scotia and the senior use-of-force expert in the division.

Why do these easily avoidable problems continue to happen? Either legal teams are just being sloppy, or they haven’t educated themselves on the risks and benefits of using the proper tool for the job (see Comment 8 of Model Rule 1.1).

This debacle is much more common in today’s world of PDFs and digital files, but most folks may only recall the more notorious and newsworthy incidents. For example, Paul Manafort’s lawyers attempted to redact PDFs with black boxes, but left the underlying text intact that revealed Mr. Manafort continued to make false statements after signing a plea deal. Or when Democrats on the House Benghazi Committee attempted to redact the transcripts of Sidney Blumenthal’s testimony that appeared to shed a dark spot on both sides of Congress’ dealings with Mr. Blumenthal.

Another court granted a plaintiff’s motion for sanctions when the defendant failed to properly redact documents containing confidential information (e.g. social security number, financial account number, birthdays, etc.). The Court stated that Defendant’s “failure to comply with the Federal Rules has placed privileged personal information on the court’s CM/ECF system, an internet system, and has cost [Plaintiff] and the court time and energy in sealing the aforementioned documents.” The Court allowed Plaintiff to recover reasonable attorney’s fees related to the motion to seal and the motion for sanctions.

There is also a "defensive mechanism" that can counteract the effects of a stun gun, said Knapman, but he wouldn't reveal what that was.

"There's a really big difference between being administered an electromagnetic shock and being dealt a fatal blow from a firearm," said Lombard.

The fallout can certainly go further – one magistrate judge demanded counsel explain why they should not be sanctioned for a memorandum filed with the court that exposed testimony that was protected by grand jury secrecy rules. The lawyer replied that there was a “technical weakness” in the redaction process when a Microsoft Word document was converted to PDF and black boxes were applied. The lawyer said the redactions were “defeated” by a journalist who simply selected and copied the black boxes and subsequently pasted the text into a new document.

In New Brunswick and in Nova Scotia, at least two people have died in recent years after the weapons didn't immobilize them.

Many PDF software packages can apply redactions, but you must use the right tool and functions. For example, Acrobat Standard allows you to draw a “black box” anywhere on the PDF (including over text), but that is NOT a true redaction – it merely draws a black box on the image layer. You must use the Acrobat Pro version – and follow the right steps – if you intend to “scrub” and redact the text layer (see comparison).
